The Kerala High Court has directed the Central Bureau of Investigation (CBI) to take over the investigation into 23 child deaths in Palakkad district over a span of 13 years. A Division Bench comprising Chief Justice Soumen Sen and Justice Syam Kumar V.M. passed the order while hearing a Public Interest Litigation concerning the unnatural deaths of children in the district.
The PIL and Child Deaths
The PIL was filed bringing to the Court’s attention the unnatural deaths of 23 children in Palakkad district over a period of approximately 13 years. The petitioner raised concerns about whether these deaths were properly investigated by the local police and whether adequate steps were taken to identify the cause of death and bring perpetrators to justice, if any criminal act was involved.
The allegations in the PIL suggested that the local police investigations into these deaths were inadequate and that there may be a pattern or common thread linking some of these deaths that warranted a fresh, independent investigation.
High Court’s Direction
The Kerala High Court, after examining the material on record, found sufficient grounds to direct a CBI investigation. The Division Bench observed that given the number of deaths, the period involved, and the concerns about the quality of local police investigations, an independent investigation by the CBI was warranted in the interest of justice.
CBI is India’s premier investigation agency, functioning under the Delhi Special Police Establishment Act, 1946. Courts have the power to direct CBI investigation in appropriate cases where local police investigations are suspected to be biased or inadequate.
